These Terms of Use (the "Terms") apply to your use of www.43re.com and its pages, tools and forms (the "Site"). The Site is operated by M2 Idaho, LLC dba Better Homes and Gardens Real Estate 43° North ("43° North," "we," "us" or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the "Last updated" date above. Changes apply to your use of the Site after they are posted. Your continued use of the Site means you accept the updated Terms.

2. Using the Site

You may use the Site for your own personal, non-commercial purposes, such as looking for a home, learning about the market or contacting one of our agents. You agree not to:

  • Use the Site in a way that breaks any federal, state or local law, including the Fair Housing Act, the Civil Rights Acts of 1866 and 1964, the Americans with Disabilities Act, the Equal Credit Opportunity Act and the CAN-SPAM Act;
  • Try to get unauthorized access to the Site, its servers or any account, or get around any security or rate limit;
  • Copy, scrape, crawl, harvest or collect listing information or other content from the Site with a robot, spider, script or other automated means, or by manual copying in bulk;
  • Reproduce, sell, resell, republish or redistribute listing information or other content from the Site, or use it to build a database or another website, app or service;
  • Send spam, junk mail, chain letters or other unsolicited messages through the Site's forms;
  • Pretend to be someone else, including one of our agents or staff, or give false information in a form;
  • Post or send anything unlawful, defamatory, harassing, threatening, obscene or hateful, or anything that infringes someone else's rights;
  • Upload viruses or other harmful code, or do anything that could disable, overload or damage the Site or get in the way of other people using it.

We may limit, suspend or block anyone's access to the Site at any time, for any reason, including to protect the Site, our visitors or the listing data we display.

3. Listing Information

The data relating to real estate for sale on this Site comes in part from the IDX program of the Intermountain Multiple Listing Service ("IMLS"). Real estate listings held by brokerage firms other than Better Homes and Gardens Real Estate 43° North are marked with the IMLS logo, and detailed information about them includes the name of the listing brokerage. Information provided by IMLS is deemed reliable but not guaranteed. IDX information is provided exclusively for consumers' personal, non-commercial use, and it may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. IMLS does not assume any liability for missing or inaccurate data.

Listings are subject to prior sale, price changes, withdrawal and errors. Square footage, lot size, school information and other details come from the listing brokerage or public records and should be checked independently. Always confirm important details with a licensed real estate professional before you make a decision.

4. Estimates, Reports and Other Information

Home value estimates, pricing tools, market reports, guides and articles on the Site are for general information only. An estimate is not an appraisal, a broker price opinion or a guarantee of what a home will sell for. Nothing on the Site is legal, tax, lending, financial or other professional advice. Using the Site does not create an agency relationship between you and 43° North or any of our agents. An agency relationship is created only by a signed written agreement with 43° North.

5. Information You Send Us

When you fill out a form on the Site (for example, to ask about a home, request a showing, get a pricing report or join an email list), you agree that the information you give is true and that it is yours to give. We use it to respond to your request and as described in our Privacy Policy. You can unsubscribe from our marketing emails at any time with the link in each email.

6. Fair Housing

43° North is committed to the letter and spirit of the federal Fair Housing Act and all state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin or any other protected class. See our Fair Housing Notice.

7. Ownership of the Site and Its Content

The Site and its content, including text, graphics, photos, video, guides, reports, designs and software, are owned by 43° North or by the people and companies that license them to us, and are protected by copyright, trademark and other laws. Listing photos and descriptions belong to the listing brokerages and their licensors. Except for viewing and printing pages for your own personal, non-commercial use, you may not copy, modify, distribute or create derivative works from the Site or its content without our written permission.

Better Homes and Gardens®, BHGRE® and the Better Homes and Gardens Real Estate Logo are registered service marks owned by Meredith Operations Corporation and licensed to Better Homes and Gardens Real Estate LLC. Each franchise is independently owned and operated. Any services or products provided by independently owned and operated franchisees are not provided by, affiliated with or related to Better Homes and Gardens Real Estate LLC nor any of its affiliated companies.

8. Feedback

If you send us ideas, suggestions or other feedback about the Site, we may use them without any obligation to you.

9. Links and Services From Other Companies

The Site links to, and uses services from, other companies, such as maps, video players, social media sites, scheduling tools and lenders. We do not control those sites or services and are not responsible for their content, accuracy or privacy practices. Your use of them is governed by their own terms and policies.

10. Copyright Complaints

If you believe content on the Site infringes your copyright, please send us a written notice that includes: your contact information; a description of the copyrighted work; the address of the page where the material appears; a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and your physical or electronic signature. Send notices to the address in section 15. We will remove material that infringes someone else's copyright.

11. Disclaimer of Warranties

THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE AVAILABLE WITHOUT INTERRUPTION, FREE OF ERRORS OR FREE OF VIRUSES OR OTHER HARMFUL CODE.

12. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, 43° NORTH AND ITS OWNERS, AGENTS, EMPLOYEES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY INFORMATION ON IT, EVEN IF WE WERE TOLD THESE DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT BE MORE THAN ONE HUNDRED DOLLARS ($100). Some states do not allow certain of these limits, so some of them may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless 43° North and its owners, agents, employees, licensors and service providers from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your use of the Site in violation of these Terms or of any law, or from your violation of anyone else's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought only in the state or federal courts located in Ada County, Idaho, and you agree to the jurisdiction of those courts.

16. Other Terms

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site. If any part of these Terms is found to be unenforceable, the rest will remain in effect. If we do not enforce a part of these Terms, that does not waive our right to enforce it later. We may assign our rights under these Terms; you may not assign yours without our written consent. Sections 3, 4 and 7 through 16 continue to apply after you stop using the Site.
